GENERAL TERMS AND CONDITIONS OF SALE
PRECONDITIONS RECOMMENDATIONS:
We recommend that you carefully read these conditions of sale which form a contractual relationship between “Armagnacs Pichon Longueville”and it’s customers. All of the products presented on our site are produced by us at Chateau de Briat.
1. Orders
Every order implies full and unreserved acceptance of these conditions, prevailing over any other document or condition of purchase and/or supply issued by the customer.
All orders are binding and final from the moment of order confirmation.
For internet sales, the order is considered confirmed from receipt of payment.
However, given the random character of harvest, ABPL SAS company reserves the right to not fulfill orders or groups of orders from customers, which exceed the capacities of production.
2. Prices
2.1. Products are invoiced at the applicable rates of metropolitan France on the day of delivery. They correspond to those that are listed on the site and known by the customer on the date of order.
2.2. The list price includes all taxes, before postage and handling for all orders below 6 bottles.
For 1 bottle, postage and handling 7 €
For 2 bottles, postage and handling 12€
For 3 bottles, postage and handling 16 €
For 4 bottles, postage and handling 19 €
For 5 bottles, postage and handling 22 €
2.3. The pricing structure of Société ABPL SAS is available for any professional buyer, on request.
3. Payment terms
3.1. Invoices issued by the Société ABPL SAS are payable to the registered office of ABPL SAS . They carry all obligatory mentions with regard to regulations in force, at the exclusion of all others.
3.2. For businesses, invoices are payable 30 days after the end of the month in which delivery was received. Payment is deemed made on the date in which funds are made available by the client to ABPL SAS
3.3. Société ABPL SAS accepts payment by wire transfer, check, bill of exchange. All wire transfers must be credited to the account of ABPL SAS by the last day of the month.Checks must be received by ABPL SAS no later than 7 calendar days before date d’échéance. bills of exchange must be received by ABPL SAS signed and accepted 12 calendar days before the date d’échéance. In every case, the postmark will be taken as proof of date.
3.4. In case of dispute over an order or an invoice, the customer agrees not to suspend payment of invoice. Customer agress to may the undisputed amount heretofor.

4. Deliveries - returns
4.1. Delivery times and unloading are indicative and delays shall not under any circumstances result in retention, compensation or cancellation of the order. The minimum time period between acceptation of an order and delivery of products by SociétéStéphane de Luze – Les ArmagnacsPichonLongueville is 5 working days.
4.2. In the event of missing, lost or damaged goods, it the responsibility of the customer to notify the carrier within 3 days, via registered letter, with precise, complete observations on the delivery documents, in accordance with article L133-3 of the new French commercial code.
Furthermore, the customer is obliged, where required, to nominate an expert.
Customers are also required to send a duplicate of this letter, without hesitation to ABPL SAS
5. Reservation of Ownership – Risks
5.1. It is explicitly agreed that products remain the property of Société ABPL SAS until full payment by the customer.
5.2. Full risk of goods passes to the customer on delivery. The customer undertakes to assume all necessary care in keeping and conserving the products and will personally make sure that all necessary insurances are in place from the moment of transfer of risk
5.3. Will be considered as a fortuitous cas or force majeure liberating ABPL SAS of its obligation to delivery : fire, flooding, disease outbreak, war, riots, partial or total strike action, lock-out, difficulty in supply of raw materials or energy, manufacturing incidents, disturbances in transport and all other event making it reasonably impossible the continued production and dispatch of goods.
6. Intellectual property
Any reproduction of a brand, logo or visual belonging to ABPL SAS & SCA de Briat must conform to and respect trademark or respect their requirements.
7. Internet Site Copyrights
ABPL SAS remain legal authors and order of any and all parts of databases existing on the current site, in accordance with provisions of the lawn° 98-536 of July 1st, 1998. For that matter, it is forbidden to extract, reuse, store, reproduce, represent or save, directly or indirectly, on any type of support, through any means and under and format, all or part, substantially qualitatively or quantitatively, the contents of the databases making up the website of ArmagnacsPichonLongueville–all rights reserved – http://www.armagnacs-pichon-longueville.com

8. Legislation
All products proposed for sale by ABPL SAS & SCA de Briat fulfill the framework and respect French legislation.
Sale of spirits by Armagnac Pichon Longueville strictly reserved to adults or those deemed to be adults by their national legislation (18 years in France)
The purchase of these products from another country cannot engage the responsibility of ABPL SAS & SCA de Briat in the case of eventual non-respect of legislation in individual countries.
9. Assignment of jurisdiction
All litigation relating to present terms and conditions will be subject to the exclusive jurisdiction of the courts of Mont de Marsan, unless otherwise stated, ABPL SAS prefers to submit the case to any other competent jurisdiction.
